Official Rules for Tahoe Creamery’s Free Ice Cream for a Year Instant Win Game
OFFICIAL RULES:
1. HOW TO PLAY: Eat your way to the bottom of any Tahoe Creamery pint of Tahoe Dream Vanilla Bean (16 oz.), Tahoe Toffee Crunchy Coffee (16 oz.), Tahoe Swell Cinamel (16 oz.), Tahoe Trip Mint Chip (16 oz.), Tahoe Flow Cookie Dough (16 oz), Tahoe Crest Chocolate Conquest (16 oz.), Tahoe Flight Blueberry Delight (16 oz.) and Tahoe Funk Chocolate Hunk (16 oz.), (“Participating Products”) for a winning notice at the bottom of the pint. The winning notice will be found underneath a protective lining at the pint’s bottom. If your Tahoe Creamery Pint does not have a protective lining and a winning notice underneath the protective lining you are not a winner. You may also request a chance to obtain a winning pint for free and a copy of the Official Rules by sending a self addressed stamped envelope to: Tahoe Creamery’s Free Ice Cream for a Year Instant Win Game, Attn: Chance/Rules, 2248 Meridian Blvd., Suite H, Minden, NV 89423. VT residents may omit return postage. Request for a chance to obtain pint/rules must be postmarked by 12/10/09 and received by 12/17/09. Limit one (1) request per outer stamped mailing envelope. TC Operations LLC, the distributor of Tahoe Creamery (“Sponsor”) is not responsible for lost, late, misdirected, illegible, incomplete, damaged, postage due, or mutilated mail. Sponsor is not responsible for any pints that are illegible, mutilated, altered, duplicated, tampered with, forged, cut, torn, contains printing, typographical or other errors, distributed where prohibited by law or not obtained legitimately and Sponsor will not provide a replacement pint.
2. ELIGIBILITY: Open to legal residents of the fifty (50) United States and District of Columbia who are 6 years of age or older. Employees of Tahoe Creamery, its parent company, subsidiaries, affiliates, advertising and promotion agencies, participating retailers and immediate family members and/or those living in the same household of each are not eligible to participate. Void where prohibited.
3. TO REDEEM A PRIZE: If you receive an Instant Win Pint, follow the instructions on the bottom of the pint in order to redeem the prize. You must retain the Instant Win Pint in order for sponsor to view it and verify that you are a winner. Neither Sponsor, its related, affiliated or subsidiary companies, or any co-sponsors of this promotion, nor its advertising or marketing agencies are responsible for lost, late, damaged, incomplete, illegible, postage due, misdirected or mutilated claims. Prize claims are subject to verification by an independent judging organization, whose decisions are final. Instant Win Pint that is illegible, mutilated, altered, duplicated, tampered with, forged, cut, torn, contains printing, typographical or other errors, distributed where prohibited by law or not obtained legitimately will be void. If by reason of printing or other error, more Instant Win Pints are claimed than number set forth in Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the number of prizes in question. No more than advertised number of prizes will be awarded. If the Tahoe Creamery Pint does not contain the protective lining and notification you are not eligible for a prize. The redemption of an Instant Win Pint is solely the responsibility of the participant.
4. PRIZE SELECTION: An Instant Pint Winner (hereinafter “Winner”) shall receive three (3) two and one half (2½) gallon tubs of ice cream for a total of seven and one half (7½) gallons of ice cream. Winner may select up to three different flavors of ice cream made by Tahoe Creamery in the month of Winner’s notification. Winner may pick up the ice cream at a Tahoe Creamery location in Minden, Nevada or Reno, Nevada or may pay to have the ice cream shipped via Fed Ex one day delivery (with the ice cream kept cold with dry ice) to anywhere in the United States. Tahoe Creamery shall charge Winner a $15.00 packaging fee on top of the Fed Ex shipping fee paid for by Winner for such orders. All three tubs of ice cream shall be picked up or shipped at once. Winner may select a Favorite Grocer to receive the same prize under the same terms and conditions. Winner is not required to select a Favorite Grocer. In the event Winner and their Favorite Grocer are amenable to appear in a Tahoe Creamery commercial without compensation to acknowledge their winning, Tahoe Creamery may, in its sole discretion, create such a commercial.
5. PRIZES/APPROXIMATE RETAIL VALUE (ARV)/ODDS: Twenty-five (25) Prizes per year – 7 ½ gallons of ice cream (ARV $150)/1:1,200. Total ARV of all prizes $3,750 if one winner; $7,500 if all grocers are selected. Odds are based upon 30,000 pints sold each year. Odds will fluctuate based upon the number of pints sold. All Instant Win Pints won by a minor will require activation by his/her parent or legal guardian. Parents/legal guardians of minor winners must call (866) 498-8900 no later than 12/15/09 to arrange for the receipt of ice cream. Winning pints expire 12/15/09 unless extended in the sole discretion of Tahoe Creamery. For minor winners – a parent’s/legal guardian’s signature may be required at time of redemption. Unclaimed prizes will not be awarded. All applicable federal, state, and local taxes on prizes are the sole responsibility of the prize winners.
6. GENERAL: No correspondence will be acknowledged. No cash equivalents, substitutions or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that the advertised prize is unavailable. Subject to all federal, state and local laws/regulations. By participating, winners (and winner’s parent/legal guardian, if winner is a minor) consent to the use of his/her name, photo and/or likenesses for advertising and promotional purposes, without limitation or additional compensation, where permitted by law and agree to hold harmless and release Sponsor, its affiliates, directors, employees, officers and agents, including without limitation, their advertising/promotional agencies from any and all liability, injury, loss or damage of any kind, arising from or in connection with participation in the Game, or the awarding, receipt, possession, use or misuse of any prize and/or with respect to participation in any prize related activity. Winners acknowledge that neither Sponsor nor its agents have made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize, if any, are subject to the manufacturers’ terms therefore and winner agrees to look solely to such manufacturers for any such warranty and/or guarantee. Sponsor is not responsible for any typographical or other error in printing, offering or announcement of prizes. By participating in this promotion, entrants (and entrant’s parent/legal guardian, if entrant is a minor) agree to be bound by the Official Rules and the decisions of the judges, which are final and binding in all respect.
